Please read these terms and conditions carefully before using DogArt.ai. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Definitions

  • Company ("we," "us," "our") refers to Riley Ventures LLC (DBA Acme Studio), 1615 South Congress Avenue, Suite 103, Delray Beach, FL 33445, operating DogArt.ai.
  • Service refers to the DogArt.ai website at https://dogart.ai and all related services.
  • Digital Goods refers to AI-generated portrait files delivered electronically.
  • Physical Goods refers to printed products (canvas prints, framed prints) shipped to customers.
  • You ("Customer," "User") means the individual or entity accessing the Service.
  • Order means a request to purchase Digital Goods and/or Physical Goods through the Service.

2. Service Description

DogArt.ai provides AI-generated dog portrait services. Users upload a photo of their dog, select an art style, and receive a custom AI-generated portrait. Portraits are available as:

  • Digital downloads — high-resolution 4K files delivered instantly via email.
  • Canvas prints — gallery-wrapped canvas prints in multiple sizes, shipped to US addresses.
  • Framed prints — professionally framed fine art prints in multiple sizes and frame colors, shipped to US addresses.

We also offer a free watermarked preview before purchase so you can see exactly what your portrait will look like.

3. Eligibility

You must be at least 18 years of age to use this Service. By placing an Order, you represent and warrant that you are legally capable of entering into binding contracts.

4. Placing Orders

4.1 Your Information

When placing an Order, you may be asked to provide your name, email address, payment information, and (for Physical Goods) a shipping address. You represent that all information you provide is true, accurate, and complete.

4.2 Order Acceptance

We reserve the right to refuse or cancel any Order at our sole discretion, including for suspected fraud, unauthorized transactions, pricing errors, or product unavailability. If we cancel an Order you have already paid for, you will receive a full refund.

4.3 Pricing

All prices are displayed in US Dollars (USD). Prices are subject to change without notice. The price at the time of your Order is the price you will be charged. Promotional codes may not be combined unless explicitly stated.

5. Payment

Payment is processed securely through Stripe. We accept Visa, MasterCard, American Express, Apple Pay, and Google Pay. Payment is collected at the time of Order. You represent that you have the legal right to use the payment method provided.

6. Digital Goods

6.1 Delivery

Digital portraits are typically generated and delivered within 60 seconds of payment. Delivery times may vary during peak periods. You will receive an email with download links and can also access your portraits from your account page.

6.2 Refunds

All digital sales are final. Due to the custom AI-generated nature of each portrait and the non-recoverable processing costs incurred, we do not offer refunds on Digital Goods. However, if you are not satisfied with your portrait, we will regenerate it for free. Contact bark@dogart.ai.

6.3 License

Upon purchase, you receive a perpetual, worldwide, non-exclusive license to use your AI-generated portrait(s) for personal and commercial purposes. You may print, share, display, and use the images in products, social media, and marketing materials. We do not retain exclusive rights to your generated artwork.

7. Physical Goods

7.1 Shipping

Physical Goods (canvas prints and framed prints) are currently available for delivery to United States addresses only. Orders are produced within 3–5 business days and shipped via FedEx Ground with an estimated transit time of 5–7 business days. Shipping is included in the product price at no additional cost.

7.2 Production

Physical Goods are custom-produced by our printing partner. Each item is made to order and cannot be restocked or resold. Production begins promptly after payment is confirmed.

7.3 Damaged or Defective Items

If your Physical Goods arrive damaged or defective, contact us at bark@dogart.ai within 7 days of delivery with photos of the damage. We will ship a free replacement at no cost. You do not need to return the damaged item.

7.4 Returns

Because all Physical Goods are custom-produced, we do not accept returns on items that are not damaged or defective. Physical Goods that are personalized or made to your specifications cannot be returned under any circumstances.

7.5 Order Cancellation

Once a Physical Goods order has been submitted to our production partner, it cannot be cancelled or modified. If you need to make changes, contact us immediately at bark@dogart.ai and we will do our best to accommodate your request, though we cannot guarantee changes can be made.

8. User Responsibilities

  • You are responsible for providing accurate Order information, including shipping addresses for Physical Goods.
  • You must have the right to use any images you upload. Do not upload copyrighted material you do not own.
  • You agree to use the Service for lawful purposes only.
  • You are responsible for any costs associated with incorrect shipping addresses.

9. Prohibited Use

You may not use the Service to:

  • Generate content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
  • Upload images you do not have the right to use.
  • Attempt to reverse-engineer, overload, or otherwise misuse the Service or its APIs.
  • Use automated scripts or bots to access the Service in a manner that exceeds reasonable use.
  • Resell or redistribute the Service itself (your generated portraits may be used commercially under your license).

We reserve the right to immediately suspend or terminate accounts found in violation of this section.

10. Intellectual Property

10.1 Our Property

The Service and its original content (excluding user-uploaded photos and AI-generated portraits), features, and functionality are the exclusive property of the Company and its licensors. This includes our brand name, logo, website design, and proprietary technology.

10.2 Your Content

You retain ownership of any photos you upload. By uploading, you grant us a limited license to process the image for portrait generation. We do not sell or share your uploaded photos with third parties except as necessary to fulfill your Order (e.g., sending to our printing partner for Physical Goods).

10.3 Generated Portraits

You receive full commercial rights to your generated portraits as described in Section 6.3. We retain the right to use anonymized or aggregated examples of generated portraits for marketing, portfolio, and promotional purposes unless you opt out by contacting us.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in our Privacy Policy.

12. Charitable Donations

20% of every purchase is donated to dog shelters & rescues. Donation amounts are calculated on the purchase price and are made at our sole discretion. Charitable contributions do not entitle you to any tax deduction or additional rights.

13. Service Availability

We strive to maintain high availability but cannot guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage arising from service interruptions.

14. Limitation of Liability

To the maximum extent permitted by applicable law, DogArt.ai and its suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or goodwill) resulting from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100 USD, whichever is greater.

15. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or uninterrupted.

16. Indemnification

You agree to indemnify and hold harmless the Company, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Palm Beach County, Florida.

18. Dispute Resolution

If you have any concern or dispute about the Service, you agree to first try to resolve the dispute informally by contacting us at bark@dogart.ai. We will make reasonable efforts to resolve your concern within 30 days.

19. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to accomplish its objectives to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

20. Changes to These Terms

We reserve the right to modify these Terms at any time. If a revision is material, we will make reasonable efforts to provide notice (such as a banner on the website or an email). Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
